Lesson 3: Compensation, Confidentiality, and Buyer Duties

Know the working relationship, the services, and the pay terms before you make assumptions.

Key idea: Representation, pay, privacy, and buyer duties are related. Each question still needs its own answer.

Working With an Agent Is Not the Whole Answer

Ask what relationship actually exists

A buyer may know or speak with an agent. That alone does not answer every relationship question.

Ask what role applies. Ask what agreement controls the relationship. Ask what each side must do.

Representation Should Be Clear

Know the terms that apply to you

The details can vary by brokerage, agreement, and deal.

A buyer should ask:

  • Who does the real estate professional represent?
  • Is the relationship exclusive?
  • What services are included?
  • How long does the agreement apply?
  • How is compensation handled?
  • What property types or areas are covered?
  • What happens if circumstances change?

Do not assume one answer fits every buyer or agreement.

The Agreement Matters

Read the actual document before signing

A written buyer agreement may cover services, time, pay, duties, and how the relationship works.

Those terms can vary. Read your agreement and ask about anything you do not understand.

A broker or agent can explain services and business terms. Ask a Florida real estate attorney about legal meaning, rights, or legal effects.

Representation and Compensation Are Different

Two questions, not one

Representation asks: Who is the professional working for, and what role do they have?

Compensation asks: How is that professional paid?

The answers may affect each other. They are still not the same question.

Do not assume the builder always pays. Do not assume the seller always pays. Do not assume the buyer never pays. Do not assume a standard commission rate.

Confidentiality Depends on the Relationship

Know what information can be protected

Privacy duties can depend on the brokerage relationship and the facts.

Ask what information the agent must keep private and what limits apply.

Do not assume every relationship creates the same privacy duty.

Buyer Duties and Expectations

The buyer may have duties under the agreement too

A written agreement may set duties for the buyer.

These can vary. Read the document. Ask what the buyer must do, what notices are needed, and what happens if things change.

Ask a Florida real estate attorney about enforceability, legal duties, ending the agreement, or legal consequences.

New Construction Adds an Extra Timing Question

Your agent agreement does not control the builder's policy

A buyer may have an agent agreement and still need to understand the builder's separate registration rules.

Ask about:

  • The builder's current registration policy
  • When the agent must be identified
  • Whether the agent must accompany the buyer
  • Whether the builder recognizes outside-agent involvement
  • How the builder handles compensation

Do not assume the buyer agreement controls the builder's registration policy.

Realistic Buyer Example

Two systems, two sets of questions

A Florida buyer has been speaking with an agent and plans to visit a new-home community.

Before going, the buyer asks, “What is our professional relationship?” and “Do we have a written agreement?”

The buyer also asks what services are included, how pay is handled, and what the builder requires for registration.

The buyer separates two questions. What relationship exists with the agent? What policy does the builder use?

Aha Moment

Your agent relationship and the builder's registration process are different systems

Knowing your agent relationship does not answer the builder's registration rules.

Know both systems before you make assumptions.

Questions Before Signing a Representation Agreement

Ask before you assume

  • Who do you represent?
  • Is this agreement exclusive?
  • How long does it apply?
  • What services are included?
  • How is compensation handled?
  • What happens if I want to end or change the relationship?
  • Does the agreement cover new construction?
  • How should we handle builder registration?
Who Can Verify What?

Use the right source for each question

Buyer's Real Estate Broker or Agent

Can explain their services, role, and business practices within their scope.

Brokerage

Can explain brokerage policies and the agreement structure it uses.

Florida Real Estate Attorney

Can explain legal terms, rights, duties, ending terms, and legal consequences.

Builder's Authorized Representative

Can explain the builder's current registration and outside-agent rules.

Professional Wall

General education is not contract interpretation

Boundary: This lesson does not replace a review of your agreement. Ask a Florida real estate attorney about legal rights, enforceability, ending terms, contract meaning, or consequences.
Knowledge Check

Check the idea, not a score

This is a learning check. There are no grades and no passing score.

1. Are representation and compensation the same question?

2. Why should a buyer read the written agreement?

3. Does the buyer's agreement automatically control the builder's registration policy?

4. Who should interpret legal termination rights in an agreement?
